IF I FIRE MY PERSONAL INJURY ATTORNEY DO I HAVE TO PAY ANYTHING TO CHANGE ATTORNEYS?
First, you can take comfort from the fact that the choice on who represents you is yours. It is not the choice of the attorney. This is also true with critical decisions in your case, like when to resolve the case, and for how much; those are both your decisions. No, there is only one attorney’s fee. If the old law firm claims they have spent costs toward your case we obtain that information, as well as all the information about your case. If your old law firm claims they have placed work in your case, when we successfully conclude your case, we work out any claim they have for the time they spent on your case. It will not cost you more to change attorneys. We work on contingency and that means we only get paid after you get paid. We always keep in mind that the better we do for you means the better we do for this firm. We also honor the principle that it is client who decides when a case resolves.
HOW DO I FIRE MY ATTORNEY, HOW IS IT ACTUALLY DONE?
Again, if you want to change attorneys it is your choice. When a new client is leaving their old law firm, we simply send a letter on their behalf to that old law firm which informs them that “Mr. Jones has signed up with this firm, and Mr. Jones now instructs that the [assembly-line] law firm take no further action on Mr. Jones’ behalf”. That is it. That is all that is required for you to change attorneys.
- You do not have to talk with the old law firm.
- You do not have to visit the old law firm.
- You do not have to ask permission to leave the old law firm.
At that point we run forward with your case and prosecute it for you and work toward a successful completion.
