LG OR SAMSUNG OVEN FIRE, WHAT ARE MY RIGHTS IN FLORIDA FOR DAMAGE?

The Consumer Product Safety Commission, known as “CPSC” recently noted that LG Electronics is recalling 500,000 electric ranges due to “activation” incidents. Meaning, the range was not intended to be turned on but in many cases due to the forward mounting of the knobs, pets were turning on the stove when no one was home. According to the CPSC they received 86 reports of accidental activation, and in some of these cases they included burns to people and death of pets.

THE CURRENT FIX FOR THESE STOVES IS NOT GOOD ENOUGH

One client contacted LG to find out LG’s intentions about the ranges which can be accidentally turned on by pets or kids. In response, LG is: 1. offering free warning labels and instructions for placement, 2. urging consumers to use the control lock function and 3. keep children and pets away from the knobs. This is not particularly effective. When the power goes out the lockout control goes out. This means if the pets are home and the electricity goes out, the control lock on the stove will not be activated. If your pet or later your child unintentionally turns the knobs on the stove to the “on” position, the LG stove would not be locked out.

LG needs to develop a technical fix where when the power goes out the power knobs on the stove turn to the lock position—not the unlocked position.

WHAT IF MY HOME WAS DAMAGED BY AN LG STOVE?

In the State of Florida when a defective product causes you harm you have the ability to pursue a claim against the seller, the distributor, and the manufacturer of the product. This can mean taking a case against a commercial seller like Home Depot, Lowe’s, Best Buy, etc., and against the importer of the product, as well as the manufacturer, LG. The same is true if the defective stove caused personal injury to you or your family. This is a serious problem which LG needs to correct. A pet could turn on the stove while you and your family are sleeping in your house. Just providing a label is not going to solve that problem.

Samsung also had a similar recall on its ranges because of fire hazards. Samsung had to recall more than 1 million stoves due to fire hazards. The Consumer Product Safety Commission is investigating range activation cases after being apprised of hundreds of incidents, including injuries and deaths.

SUMMARY OF LG AND SAMSUNG STOVE RECALLS

Both Samsung and LG, the makers of these stoves have had to issue recalls because of safety concerns about inadvertent activation of their stoves by pets or kids. It is not good enough that LG has recently only proposed to send a sticker to be placed on the defective and dangerous stoves.
